Purpose: This is an act passed by Parliament to provide for the probation of offenders – the placing of offenders under the supervision of specific officers called Probation Officers for a certain period of time.
Important definitions. (Section 2)
Probationer – a person placed under the supervision of a Probation Officer.
Probation Officer – officers appointed to supervise offenders.
Probation Order – an order of court directing that a particular offender be placed under the supervision of a Probation Officer for a specific period of time.
WHY WOULD AN OFFENDER BE PLACED UNDER PROBATION?
Where a person is charged with an offence which should be tried by the Subordinate Courts and the Court thinks that the charge is proved but is of the opinion that it would be more beneficial to release the offender on probation, the court may either;
- convict the offender and place him on probation or
- just place him on probation without conviction.
Factors or circumstance which may make the court decide to place an offender under probation may include the offender’s:
- youth,
- character,
- background,
- home surroundings,
- health or mental condition
- the nature of the offence
- any explanatory mitigating circumstances in which the offence was committed
TERMS OF A PROBATION ORDER
Court has duty to explain to the offender in a language that he understands, the meaning of their probation order. If an offender does not keep the terms of the Probation Order there are consequences. Some of the terms of a Probation Order are:
- The Court may require the offender under a probation order to deposit some money (bail) in court that is returned once the probation period is over. Sec 4 (1) & (2).
- If the offender does not comply with the terms of the order or commits another offence within the probation period, the money paid will not be returned to him. Sec 4 (4).
- If the Offender does not adhere to the order or commits another offence within the specific period, the court shall sentence him for the original offence. Sec 4 (3).
- A court will not make a probation order if the offender is not willing to comply with its terms (of the order). Sec 4 (3)
- Probation Orders are made for periods ranging between 6 months and 3 years from the date of the order. I
CHARACTERISTICS OF A PROBATION ORDER
A Probation Order requires the probationer to (Sec 5):
- Submit to the supervision of the probation officer.
- May require him to reside in a particular place for a specific period, but not for more than a year in the case of an institution.
- Adhere to other conditions that court thinks are necessary for his supervision
- The Court makes 2 copies of the order; 1 for the probationer and 1 for probation officer.
- When placed under probation the Court still has the power to order that the offender pay costs or damages for injury or compensation for loss. (Sec 6)
WHAT HAPPENS IF AN OFFENDER UNDER PROBATION IS CHARGED WITH AN OFFENCE WHILE SERVING A PROBATION ORDER?
- Any judge/ magistrate may issue summons to appear or arrests warrants to the offender who is under probation where the offender commits an offence while in probation.
- The judge/magistrate may then put the offender in custody or release him on bail as he waits to be brought before the court that put him on probation. Sec 7
- The judge then transmits to the initial court any necessary documents regarding the case. Sec 10
- If it is proved that he indeed committed a subsequent offence he is; Sec 7 (4)
- Convicted of the original offence if he had not been convicted.
- Sentenced if he had been convicted of the first offence
- If the subsequent offence is subject to conviction in the High Court, Sec 7 (5)
- High court convicts him of the first offence if he had not been convicted before and passes the sentence of the initial court (lower court).
- If he had been convicted of the first offence, High Court passes the sentences of the initial court.
WHAT HAPPENS WHEN A PROBATIONER FAILS TO COMPLY WITH ANY PROVISIONS OF THE PROBATION ORDER?
- A magistrate or judge may (Sec 8); issue summons to the probationer to appear before the court that gave the order or Issue warrants for his arrest
- The relevant court will then:
- Require the probationer to pay a fine maximum Kshs. 200 where he had not paid any bail and continue with the probation; or
- Convict the offender if he had not been convicted; or
- If he had been convicted then sentence him for the offence.
- When convicted and released on probation, this conviction is disqualified where the offender commits a second offence and the law has provided a different penalty for that subsequent offence. Meaning the offender receives a sentence as provided by law for subsequent offences and not as per the initial offence. Sec 9
Can a probation order be amended?
Yes. Sec 11
Persons who can apply for amendment of a probation order include;
- Probationer
- Principal probation officer
Only the court that made the order can amend. It does so if it is satisfied that the amendment is necessary. It cannot however reduce the probation period or extend it beyond 3 years.
What happens when a probationer moves to a different location e.g district? Sec 11 (3)
The court on application by the probation officer amends the probation order to state the new location of the new residence and transmits to a court in that location all documents and information regarding the case. The new court is from then taken as the court that made the order. The amendment may be made even when probationer is absent.
How is a probation order discharged or terminated? Sec 12
- Done at the end of probation period. Probationer or principal probation officer may apply for it. In the latter case the probationer may not be required to attend.
- Automatically terminated where the probationer is later sentenced for the offence (having committed another offence).
Who selects probation officers?
This is done by the Principal probation officer appointed by the Minister. Where the probationer is female the probation officer must be a woman. Sec 14
Principal probation officer may delegate his powers with regard to a probationer to any probation officer. Sec 18

- Appoint a Principal probation officer to organise and supervise the service
- Appoint probation officers qualified by character and experience to be probation officers
- May appoint a probation committee to review the work of probation officers in individual cases and perform such duties as may be prescribed in the rules
- Make rules to guide the provision of probation services.
Duties of a Principal Probation Officer (Para 2 of the Probation of Offenders Rules)
- To make such arrangements and to give such directions as may be necessary for the purpose of giving effect to probation orders;
- To train staff for the Probation Service;
- To act as secretary to the Central Probation Committee and to advise the Committee on all technical matters relating to the probation system;
- To act as liaison officer between the Central Probation Committee and the Commissioner of Prisons and any other authority or body concerned with the treatment of juveniles in all matters, and especially in matters relating to probation. approved schools and approved homes;
- To promote co-operation between the Probation Service and the Police Force and any other voluntary society affording appropriate social services;
- Generally to organise and supervise the Probation Service and to promote the efficient working thereof.
Roles of a probation officer (Para 3 of the Probation of Offenders Rules)
- To make such preliminary inquiries as the court may direct into the antecedents (background), home surroundings and other circumstances of an accused person;
- To undertake the supervision of such probationers as may be assigned to his charge;
- Subject to any directions given by the court (whether in the probation order or otherwise), to visit the home of every such probationer and make inquiries as to his conduct, mode of life and employment;
- To keep in close touch with the probationer and to arrange to meet him at least once a fortnight during the first six months of the period specified in the probation order and thereafter at such intervals as he may deem necessary, having regard to the conduct, mode of life and needs of the probationer;
- If the probationer is a child attending school, to make periodical inquiries of the principal of the school concerned as to the probationer’s attendance, conduct and progress: Provided that the probationer shall not, unless he is actually residing at the school, be personally interviewed by the probation officer on the school premises;
- To ensure that the probationer understands the terms and conditions of the probation order, and to endeavour by encouragement, persuasion and warning to secure his observance of them;
- To advise, assist and befriend the probationer and, where necessary, endeavour to find him suitable employment;
- If the probationer is under eighteen years of age, to endeavour to secure his association with some suitable youth movement or other welfare organisation;
- To keep proper and up-to-date records in respect of every probationer for whom he is responsible, including notes of visits and interviews and relevant details as to the conduct and progress of the probationer.
The Probation of Offenders (Central Probation Committee) Rules provide for the establishment of the Central Probation Committee to generally advise the Minister on regarding probation services.
The Probation of Offenders (Case Committees) Rules provide for the establishment of probation case committees each with a chairman and 7 members. These committees;
- examine and review the work of probation officers in relation to individual cases;
- to receive and consider reports from probation officers;
- make or direct the making of any communication to the court;
- make or direct the making to the Central Probation Committee of recommendations concerning the probation service;
- to advise and assist probation officers in the execution of their duties;
- to ensure that probation officers perform their duties in a satisfactory manner

- Offender supervision
Probation Officers supervise offenders in the community to ensure compliance to Probation Orders, Community Service Orders, Penal Release Licenses and Executive Orders.
- Juvenile supervision
Provided to a child offender serving a community sentence to minimise the risk of re-offending and ensuring public safety, all in the best interest of the child.
- Special needs offenders
They include psychiatric offenders and offenders with mental disorders. Probation officers prepare;
- Special Category Psychiatric Criminal Reports to assist the Psychiatric Release Board in seeking for the Mercy of the President.
- Leniency Reports (for irreversible mental disorder) that assist courts in determining leniency of psychiatric offenders who cannot take plea and/or proceed with court hearing.
- Capability Reports (for reversible mental disorders) assist in determining the capability of an offender to take plea or to continue with court hearing.

Probation officers assess the risks and needs of offenders in order to prepare appropriate intervention plans to treat the offending behaviour, reduce re-offending, improve the offender’s capacity for a responsible lifestyle and healthy relationship and protect the individual offender, the victim and the community at large.
